Terms & Conditions and Refund & Cancellation Policy

1. Introduction and Agreement
By purchasing any services from Jack Mann (also known as “Coach Jack Mann” and @coachjackmann), you agree to be bound by these Terms & Conditions and the Refund & Cancellation Policy set out below. These terms apply to all coaching services, including:
- Pre-written and personalised workout plans
- One-to-one coaching (online and in-person)
- Fat/weight loss coaching programmes
- Muscle gain, sports performance, and lifestyle coaching
Your purchase constitutes acceptance of these terms without requiring a signature, unless otherwise agreed in writing by both parties.
2. Service Provision and Qualifications
2.1 Coach Jack Mann is a Level 3 qualified personal trainer and Level 4 qualified strength and conditioning coach.
2.2 Medical Disclaimer: Coach Jack Mann does not dispense medical advice nor prescribe medical treatment. All information and advice provided is for informational purposes only and is not intended as medical instruction.
2.3 Pre-Participation Requirement: You must obtain clearance from a qualified medical professional before commencing any exercise or fitness programme, particularly if you have been advised on health or medical grounds not to participate in physical activity and sport.
2.4 Assumption of Risk: You acknowledge and assume all risks of injury or illness, including death, arising from following any training, nutritional, or supplemental advice provided by Coach Jack Mann.
3. Client Responsibilities
3.1 Programme Adherence: You are responsible for following the provided programme to the best of your ability, maintaining communication, tracking progress, and engaging with feedback.
3.2 Communication: You agree to communicate with Coach Jack Mann at least once per week via the agreed check-in process to enable effective coaching support.
3.3 Safety: You must:
- Maintain adequate hydration during workouts
- Stop exercising immediately if you experience pain and seek medical advice where appropriate
- Ensure your workout area is suitable, safe, and spacious enough for the activities being performed
- Perform all activities safely and in a state of adequate hydration.
4. Payment Terms
4.1 Services are provided for an agreed duration, paid either in full or on a rolling monthly basis via bank transfer or Stripe payment links.
4.2 Programme extensions can be discussed towards the end of each block and paid for separately.
4.3 Payment Commitment: Once you accept access to Coach Jack Mann services, you agree to honour all payments due, regardless of whether you choose to withdraw early due to personal circumstances.
5. Refund & Cancellation Policy
5.1 General Refund Eligibility
Refunds will only be provided under the following limited circumstances:
a) Programme Faults: If the programme is demonstrably faulty (fails to load, contains significant glitches or errors preventing its use) and the issue cannot be resolved within a reasonable time.
b) Proven Non-Delivery: If you have not received the product or service due to an error by Coach Jack Mann (e.g., system failure or lost delivery).
Refund requests under these exceptions must be made within 7 days of receiving the programme or starting the service. Requests after this period may be declined.
5.2 Fat/Weight Loss Coaching: “Results or Your Money Back” Guarantee
5.2.1 A “Results or Your Money Back” Guarantee applies to fat/weight loss coaching under these strict conditions:
- You must demonstrate using the tracking sheets provided that you have followed the programme exactly as instructed but have not seen measurable progress
- Refund requests must be submitted within the programme duration
- Exclusions: No refund will be granted if:
- The plan has not been followed
- Progress is hindered by inconsistent effort, lack of adherence, or missed workouts
- You miss two or more check-ins (through tardiness or leaving them incomplete, i.e., two or more weeks without measurements and progress photos)
5.2.2 Refund Calculation: If you meet all conditions in section 5.2.1, you will receive a refund of the total programme cost minus only the 10% administrative fee specified in section 5.3. All other deductions in section 5.3 (coaching calls, personalised programming) do not apply to this guarantee.
5.3 Refund Deductions
If you are eligible for a refund, the following deductions apply:
- 10% administrative fee to cover processing fees, payment gateway charges, and system handling
- £75 per coaching call or in-person PT session attended
- £130 for personalised programming (if applicable)
Refunds will be issued to the original payment method within 14 days of receipt of your request, minus applicable deductions.
5.4 Workout Plans – Cancellation Terms
Pre-Written Plans: Refunds available only for demonstrable faults (as per section 5.1).
Personalised Workout Plans:
- No refund if you fail to attend a scheduled set-up call without prior notice
- 50% refund if you cancel during or immediately after the set-up call
- 75% refund if you cancel before the scheduled call begins (provided no materials have been delivered)
- Full refund less administrative fees if you cancel before scheduling a call
5.5 Broader Coaching (Muscle Gain, Sports Performance, Lifestyle)
5.5.1 Results depend on your consistent effort and commitment. No outcome-based refunds are offered for these services.
5.5.2 No refunds will be provided if:
- The programme was not followed and agreed work was not completed
- Progress was hindered by lack of effort or non-compliance
5.6 Early Cancellation of One-to-One Coaching
5.6.1 Refunds for early cancellation of any one-to-one coaching will be considered at the sole discretion of Coach Jack Mann.
5.6.2 Refund amounts will be calculated based on services already provided, with deductions as outlined in section 5.3.
5.6.3 No refunds will be granted if the programme was not followed or effort was inconsistent.
6. In-Person Sessions
6.1 Cancellation and Rescheduling Policy:
a) More than 24 hours’ notice: If you cancel or request to reschedule a session with more than 24 hours’ notice before the scheduled start time, Coach Jack Mann will use reasonable endeavours to facilitate your session within the next 7 days, subject to availability and pre-agreed holiday periods.
b) Less than 24 hours’ notice: If you cancel or fail to attend a session with less than 24 hours’ notice before the scheduled start time, you will forfeit the full cost of that session. No rescheduling or refund will be provided.
c) Definition of notice period: The 24-hour notice period is calculated from the scheduled session start time. Cancellations must be communicated directly to Coach Jack Mann via text or WhatsApp.
6.2 Lateness Policy: For any in-person session, Coach Jack Mann is only required to wait 20 minutes after the agreed start time. Beyond this, he may leave the facilities and you will forfeit the cost of the session.
6.3 Partial Session: If you arrive within the 20-minute grace period, Coach Jack Mann is only required to complete the remaining time remaining for the session. No additional time will be provided to compensate for late arrival.
7. Intellectual Property
7.1 All personalised plans, workout regimes, nutrition guides, and bespoke materials are the intellectual property of Jack Mann and are non-transferable.
7.2 Once delivered, these resources are considered part of the purchased service and are non-refundable.
7.3 You agree not to pass off any Coach Jack Mann material as your own without prior written consent and/or appropriate credit.
8. Use of Images and Testimonials
8.1 Coach Jack Mann reserves the right to use any images, emails, screenshots, and testimonials within promotional materials (both web-based and offline).
8.2 You hereby consent to such usage unless you specifically indicate otherwise in writing.
9. Waiver of Cooling-Off Period
9.1 By proceeding with purchase, you acknowledge that you are waiving your right to a statutory “cooling-off period” once access to the programme or coaching services has been granted.
9.2 This waiver applies to digital content and personalised services provided immediately upon purchase.
10. Jurisdiction and Dispute Resolution
10.1 These terms are governed by the laws of England and Wales.
10.2 Any disputes will be resolved under UK law.
10.3 Coach Jack Mann retains the right to decline any refund requests that do not meet the criteria outlined in this policy.
11. Modifications to Terms
11.1 Coach Jack Mann reserves the right to update or modify these Terms and Conditions at any time.
11.2 All changes will be posted and become effective from the date stated.
11.3 It is your responsibility to review the terms periodically.
11.4 Changes will not affect purchases made before the update date unless required for legal compliance or relating to existing customer disputes.
12. Final Acknowledgment
By purchasing Coach Jack Mann services, you confirm that you have:
- Read, understood, and agreed to these Terms and Conditions and Refund & Cancellation Policy
- Obtained appropriate medical clearance to participate in physical exercise
- Understood the assumption of risk involved in following exercise and nutritional advice
- Agreed to the payment terms and refund limitations set out above
- Waived your cooling-off period rights where applicable
